Hershey Sues Again
Hershey is suing again. You may remember I spoke about them suing over someone making a Champagne Kiss. Now they’re suing Williams and Sonoma over a brownie pan. While I was going back and forth on who I supported in that case, I might be with Hershey this time.
The brownie pan separates the brownies into individual ’segments’ in the same exact pattern as a Hershey Bar, and includes the word ‘chocolate’ on the brownie right where you would expect the word “Hershey” on the label. This picture better shows what I just tried to explain:

Yeah, that does look like a Hershey bar. The reason why I agree with Hershey in this one is because most people are going to see that pan and think of a Hershey bar. And if you buy that pan, thinking it’s a Hershey product, and the pan sucks, then you get mad at Hershey when they had nothing to do with it. I hate when big businesses bully other companies, but I don’t think that’s the case here.
Hershey already has ‘proof’ of people comparing the pan to Hershey bars, based on reviews by magazines and blogs, and even the customer comments left on the product page at Williams and Sonoma. Hershey is asking for an injunction to stop sales of the pan. So, maybe if you want a collector’s item, you might want to buy one. Like now.
